The charge of forgery is also classified as “theft”, however; it has been assigned its own statute and carries its own sentencing. Forgery is charged as a class four (4) felony and has a jail term of 1.5 years to 3 years with probation eligibility for a first offense, 3 years to 6 years with one historical prior, and 8 years to 12 years with two historical priors.
- To commit forgery, a person commits forgery if, with intent to defraud, the person:
- Falsely makes, completes or alters a written instrument; or
- Knowingly possesses a forged instrument; or
- Offers or presents, whether accepted or not, a forged instrument or one that contains false information.
