Fatal Accident Claims One, Injures Three

According to reports, a fatal accident on Interstate 10 on Saturday night has left one dead and three others injured.

One individual was pronounced dead at the scene of the five-car collision. Another individual, an 85-year-old man, was unconscious and had to be extracted from his vehicle. The injured victims were transported to a local hospital, while two people refused treatment at the scene.

The accident left the HOV and left two lanes of I-10 temporarily blocked. The Department of Public Safety is currently investigating the accident and has yet to determine the cause.

Vehicular Manslaughter Defense

Vehicular manslaughter is the legal term for the crime of causing the death of another while illegally driving a vehicle. Illegally driving a vehicle can include:

  • Drinking and driving
  • Speeding
  • Reckless driving
  • Gross negligence

Any fatal vehicle accident could cause the surviving driver to face the risk of criminal prosecution for vehicular manslaughter. If you have been involved in an accident that led to someone’s death, it is important to act quickly and protect yourself by calling a criminal defense lawyer.

Charges For Vehicular Homicide Vary

The state of Arizona has no general-purpose “vehicular homicide” or “vehicular assault” law. However, a 2006 statute did criminalize some moving violations under special circumstances. In Arizona, if a person is killed or injured as a result of another’s negligent actions, the prosecutor must decide if those actions are on par with homicide or assault. In the case of many traffic collisions, the prosecutors may decide to bring criminal charges if the defendant’s driving was impaired by drinking or drugs.
