Tempe Man Killed in CVS Shootout

A Tempe man died as the result of gunshot wounds sustained in what appears to be an altercation that took place at the CVS on Mill Avenue, according to recent reports. The victim, Errun Scroggins, 21, was shot during a fight in the parking lot. Witnesses said that there were two shooters, both of whom are currently wanted for questioning in the incident. Both suspects are identified as black males in their early 20s. Police are reviewing surveillance video to try to determine what happened.

Firearm Use Aggravates Crime Charges

In Arizona, the use of a firearm in the commission of a crime can greatly increase the potential penalties associated with a conviction. For example, if someone commits an assault, he or she may face only misdemeanor charges. However, threatening someone with a firearm, even if you do not shoot, is almost always charged as a felony.

The reason for this is fairly simple: the use of a firearm greatly increases the severity of the situation for the victim. Besides the fact that the threat of much greater harm leads to instant compliance on the part of most victims, as in an armed robbery, many who use firearms in criminal activities shoot and injure or kill the victim as well. This means that lawmakers take a very serious view of anyone using a gun in any way during the commission of another crime.

Although firearm ownership is legal, Arizona also requires gun owners to comply with concealed carry laws and to avoid taking firearms into certain public locations. Violations of these laws can also result in significant penalties, even if the accused person never uses the firearm at all.
